Con la seguente informativa sulla privacy vi informiamo in particolare in merito alla natura, alla portata, alle finalità, alla durata e alla base giuridica del trattamento dei dati personali, nella misura in cui decidiamo, da soli o congiuntamente ad altri, in merito alle finalità e alle modalità del trattamento. Inoltre, di seguito vi informiamo in merito ai componenti di terze parti da noi utilizzati a fini di ottimizzazione e per migliorare la qualità dell’esperienza d’uso, nella misura in cui ciò comporti il trattamento dei dati da parte di terzi sotto la loro propria responsabilità.

di ottenere la conferma dell’eventuale trattamento dei dati che li riguardano, di ricevere informazioni sui dati trattati, di ottenere ulteriori informazioni sul trattamento dei dati e di ricevere copie dei dati (cfr. anche art. 15 del GDPR);
alla rettifica o all’integrazione dei dati inesatti o incompleti (cfr. anche art. 16 del GDPR);

Inoltre, il fornitore è tenuto a informare tutti i destinatari ai quali i dati sono stati comunicati dal fornitore in merito a qualsiasi rettifica o cancellazione dei dati o alla limitazione del trattamento effettuata ai sensi degli articoli 16, 17, paragrafo 1, e 18 del RGPD. Tale obbligo non sussiste tuttavia qualora tale comunicazione risulti impossibile o comporti uno sforzo sproporzionato. Fatto salvo quanto sopra, l’utente ha il diritto di ottenere informazioni su tali destinatari.

Inoltre, ai sensi dell’art. 21 del GDPR, gli utenti e gli interessati hanno il diritto di opporsi al trattamento futuro dei dati che li riguardano, qualora i dati siano trattati dal fornitore ai sensi dell’art. 6, comma 1, lett. f) del GDPR. In particolare, è ammessa l’opposizione al trattamento dei dati a fini di marketing diretto.

I dati dell’utente trattati durante l’utilizzo del nostro sito web vengono cancellati o bloccati non appena viene meno la finalità della conservazione, la cancellazione dei dati non sia ostacolata da obblighi di conservazione previsti dalla legge e non vengano fornite di seguito indicazioni contrarie relative a singole procedure di trattamento.

Cookie Manager

Per ottenere il consenso all’utilizzo di cookie non tecnicamente necessari sul sito web, il gestore utilizza un Cookie Manager.

Sul nostro sito web utilizziamo i cosiddetti cookie. Questo trattamento rende il nostro sito web più intuitivo, efficace e sicuro, poiché consente, ad esempio, la visualizzazione del sito in diverse lingue o l’utilizzo della funzione carrello.

La base giuridica di tale trattamento è l’art. 6, comma 1, lett. b) del GDPR, nella misura in cui tali cookie trattino dati finalizzati alla negoziazione o all’esecuzione di un contratto.

Qualora il trattamento non sia finalizzato alla negoziazione o all’esecuzione di un contratto, il nostro legittimo interesse risiede nel miglioramento della funzionalità del nostro sito web. La base giuridica è in tal caso l’art. 6, comma 1, lett. f) del GDPR.

Account cliente / Funzione di registrazione

Se create un account cliente tramite il nostro sito web, i dati da voi inseriti al momento della registrazione (ad esempio il nome, l’indirizzo o l’indirizzo e-mail) saranno raccolti e memorizzati esclusivamente per prestazioni precontrattuali, per l’adempimento del contratto o ai fini della gestione dei clienti (ad es. per fornirvi una panoramica dei vostri ordini precedenti o per potervi offrire la cosiddetta funzione “lista dei desideri”). Contemporaneamente, vengono memorizzati presso di noi l’indirizzo IP, la data e l’ora della registrazione. Non avviene alcuna trasmissione di questi dati a terzi.

Nel corso dell’ulteriore procedura di registrazione verrà richiesto il Suo consenso a tale trattamento e verrà fatto riferimento alla presente informativa sulla privacy. I dati da noi raccolti in tale occasione vengono utilizzati esclusivamente per la messa a disposizione dell’account cliente.

Qualora l’utente acconsenta a tale trattamento, la base giuridica del trattamento è l’art. 6, comma 1, lett. a) del GDPR.

Qualora l’apertura dell’account cliente serva anche all’adozione di misure precontrattuali o all’adempimento del contratto, la base giuridica per tale trattamento è anche l’art. 6, comma 1, lett. b) del GDPR.

Il consenso da voi concesso per l’apertura e la gestione dell’account cliente può essere revocato in qualsiasi momento con effetto per il futuro ai sensi dell’art. 7, comma 3 del RGPD. A tal fine è sufficiente comunicarci la revoca via e-mail (datenschutz@lemonize.de).

I dati raccolti a tal fine saranno cancellati non appena il trattamento non sarà più necessario. A tal proposito, tuttavia, da parte nostra devono essere rispettati i termini di conservazione previsti dalla normativa fiscale e commerciale.

Verifica della solvibilità e scoring

Nella misura in cui, nell’ambito della nostra offerta di beni o servizi, vi offriamo la possibilità di pagare tramite fattura e voi ne fate uso, ci riserviamo il diritto di richiedere a un’agenzia di informazioni creditizie (come ad esempio Creditreform, Schufa, Bürgel o infoscore) una valutazione della solvibilità basata su procedure matematico-statistiche. A tal fine, i Suoi dati, nella misura in cui siano rilevanti ai fini contrattuali, come ad esempio il Suo nome e il Suo indirizzo, saranno trasmessi all’agenzia di informazioni creditizie. Utilizziamo le informazioni così ottenute sulla probabilità statistica di un mancato pagamento per decidere se offrirle la possibilità di pagare tramite fattura.

La base giuridica di tale trattamento è il nostro legittimo interesse a garantire la sicurezza del credito ai sensi dell’art. 6, comma 1, lett. f) del GDPR.

Dati del server

Per motivi tecnici, in particolare per garantire un sito web sicuro e stabile, i dati vengono trasmessi dal Suo browser Internet a noi o al nostro provider e lì memorizzati. In questi cosiddetti log del server vengono raccolti, tra l’altro, il tipo e la versione del Suo browser Internet, il sistema operativo, il sito web da cui è passato al nostro sito (URL di provenienza), le pagine del nostro sito che visita, la data e l’ora del rispettivo accesso, nonché l’indirizzo IP della connessione Internet da cui avviene l’utilizzo del nostro sito web.

I dati così raccolti vengono memorizzati temporaneamente, ma non insieme ad altri dati che vi riguardano.

Tale conservazione avviene sulla base giuridica dell’art. 6, comma 1, lett. f) del GDPR. Il nostro legittimo interesse risiede nel miglioramento, nella stabilità, nella funzionalità e nella sicurezza del nostro sito web.

I dati vengono cancellati al più tardi dopo 31 giorni, a meno che non sia necessaria un'ulteriore conservazione a fini probatori. In caso contrario, i dati sono esclusi, in tutto o in parte, dalla cancellazione fino al chiarimento definitivo di un incidente.

Esecuzione del contratto

I dati da voi forniti per usufruire della nostra offerta di prodotti e/o servizi vengono da noi trattati ai fini dell’esecuzione del contratto e sono necessari a tal fine. La stipula e l’esecuzione del contratto non sono possibili senza la fornitura dei vostri dati.

La base giuridica del trattamento è l’art. 6, comma 1, lett. b) del GDPR.

I dati raccolti vengono cancellati al completamento dell’esecuzione del contratto, nel rispetto dei termini di conservazione previsti dalla normativa fiscale e commerciale.

Nell’ambito dell’esecuzione del contratto, i dati dell’utente vengono trasmessi al corriere incaricato della consegna della merce o al fornitore di servizi finanziari, nella misura in cui tale trasmissione sia necessaria per la consegna della merce o per finalità di pagamento.

La base giuridica per la trasmissione dei dati è l’art. 6, comma 1, lett. b) del GDPR.

Google Analytics

Sul nostro sito web utilizziamo Google Analytics, un servizio di analisi web fornito da Google Ireland Limited, Gordon House, Barrow Street, Dublino 4, Irlanda, una società controllata da Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, di seguito denominata «Google».

Google Analytics ci aiuta ad analizzare l’utilizzo del sito web e a misurare l’efficacia delle nostre campagne di marketing. La base giuridica è l’art. 6, comma 1, lett. a del RGPD. L’utente può revocare in qualsiasi momento il proprio consenso all’utilizzo di Google Analytics ai sensi dell’art. 7, comma 3 del GDPR tramite le «Impostazioni dei cookie» del nostro sito web con effetto per il futuro.

Informazioni quali l’ora, il luogo e la frequenza delle visite al sito web, nonché le interazioni con il sito web (ad es. percorsi di navigazione, annunci visualizzati/cliccati, clic sui link), compreso l’indirizzo IP dell’utente, vengono trasmessi a un server di Google negli Stati Uniti e lì conservati per un periodo massimo di 2 mesi.

Google LLC fa parte del «Data Privacy Framework», per il quale la Commissione europea ha adottato una decisione di adeguatezza ai sensi dell’art. 45 del GDPR:

Google raccoglie inoltre «caratteristiche demografiche» e può elaborare statistiche che consentono di ricavare informazioni su età, sesso e interessi dei visitatori del sito. Ciò avviene tramite l’analisi automatizzata di pubblicità e informazioni fornite da terze parti.

Se l’utente ha attivato gli annunci personalizzati nel proprio account Google e acconsente all’utilizzo di Google Analytics, Google può analizzare il comportamento di utilizzo su più dispositivi, ovvero in relazione a tutti i dispositivi che l’utente ha collegato al proprio account Google. Google crea così modelli relativi alle conversioni su più dispositivi; a tal fine ci vengono trasmesse solo statistiche anonime, non dati personali.

Utilizziamo Google Analytics con una funzione di anonimizzazione. In questo modo, l’indirizzo IP dell’utente viene troncato da Google all’interno degli Stati membri dell’UE o in altri Stati contraenti dell’Accordo SEE.

Google utilizza i dati raccolti per analizzare la visita dell’utente al sito web e per redigere per noi rapporti sulle attività del sito. I dati vengono inoltre utilizzati per fornire ulteriori servizi relativi all’utilizzo del sito web e di Internet. Google può eventualmente trasmettere queste informazioni a terzi, qualora ciò sia richiesto dalla legge o qualora tali terzi trattino i dati per conto di Google.

Se l’utente non acconsente alla raccolta dei dati, può impedirla installando una sola volta il componente aggiuntivo del browser per la disattivazione di Google Analytics.

Google Tag Manager

Per l’integrazione di diverse funzioni sul nostro sito web utilizziamo Google Tag Manager. Questo prodotto è fornito da Google Ireland Limited, Gordon House, Barrow Street, Dublino 4, Irlanda, una società controllata da Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, di seguito denominata «Google».

Google Tag Manager serve esclusivamente a integrare determinati contenuti nel nostro sito web e a consentire la gestione di tali funzioni tramite un’interfaccia fornita da Google.

Quando si accede al sito web, le relative funzioni vengono caricate da un server di Google, che può trovarsi anche negli Stati Uniti. In tale contesto, l’indirizzo IP dell’utente viene trattato al fine di fornire le funzioni.

Google reCAPTCHA

Sul nostro sito web utilizziamo Google reCAPTCHA per verificare ed evitare interazioni sul nostro sito web da parte di accessi automatizzati, ad esempio tramite i cosiddetti bot. Si tratta di un servizio fornito da Google Ireland Limited, Gordon House, Barrow Street, Dublino 4, Irlanda, di seguito denominata semplicemente «Google».

Tramite questo servizio, Google può determinare da quale sito web viene inviata una richiesta e da quale indirizzo IP l’utente utilizza la cosiddetta casella di immissione reCAPTCHA. Oltre all’indirizzo IP, Google potrebbe raccogliere ulteriori informazioni necessarie per l’offerta e la garanzia di questo servizio.

La base giuridica è l’art. 6, comma 1, lett. f) del GDPR. Il nostro legittimo interesse risiede nella sicurezza del nostro sito web e nella prevenzione di accessi indesiderati e automatizzati sotto forma di spam o simili.

Nel nostro sito web utilizziamo Google Maps per visualizzare la nostra sede e per fornire indicazioni stradali. Si tratta di un servizio fornito da Google Ireland Limited, Gordon House, Barrow Street, Dublino 4, Irlanda, di seguito denominata semplicemente «Google».

Quando l'utente accede al componente Google Maps integrato nel nostro sito web, Google memorizza un cookie sul dispositivo dell'utente tramite il browser Internet. With regard to the data processing described in more detail below, users and data subjects have the right

- to obtain confirmation as to whether data concerning them is being processed, to obtain information about the data being processed, to obtain further information about the data processing and to obtain copies of the data (see also Art. 15 GDPR);

- to have inaccurate or incomplete data corrected or completed (see also Art. 16 GDPR);

- to have data concerning them deleted without delay (see also Art. 17 GDPR), or, alternatively, if further processing is necessary in accordance with Art. 17(3) GDPR, to have processing restricted in accordance with Art. 18 GDPR;

- to receive the data concerning them and provided by them and to transfer this data to other providers/controllers (cf. also Art. 20 GDPR);

- to lodge a complaint with the supervisory authority if they believe that the data concerning them is being processed by the provider in violation of data protection regulations (see also Art. 77 GDPR).

If you consent to this processing, Art. 6 (1) lit. a) GDPR is the legal basis for the processing.

If the opening of the customer account also serves pre-contractual measures or the fulfilment of the contract, the legal basis for this processing is also Art. 6 (1) lit. b) GDPR.

You may revoke your consent to the opening and maintenance of your customer account at any time with future effect in accordance with Art. 7 (3) GDPR. To do so, you simply need to notify us via mail (datenschutz@lemonize.de) of your revocation.

The data collected in this regard will be deleted as soon as processing is no longer necessary. However, we must take into account tax and commercial law retention periods.

Credit check and scoring

If we offer you the option of paying by invoice for our goods or services and you make use of this option, we reserve the right to obtain credit information from a credit agency (such as Creditreform, Schufa, Bürgel or infoscore) on the basis of mathematical and statistical methods. For this purpose, your data, insofar as it is relevant to the contract, such as your name and address, will be forwarded to the credit agency. We use the subsequent information about the statistical probability of a payment default to decide whether to offer you the option of payment by invoice.

Server data

For technical reasons, in particular to ensure a secure and stable website, data is transmitted to us or our provider by your internet browser and stored. These so-called server logs collect, among other things, the type and version of your Internet browser, the operating system, the website from which you accessed our website (referrer URL), the website(s) of our website that you visit, the date and time of each access, and the IP address of the Internet connection from which you are using our website.

The data collected in this way is stored temporarily, but not together with other data about you.

This storage is based on the legal basis of Art. 6 (1) lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website.

The data will be deleted after 31 days at the latest, unless further storage is necessary for evidence purposes. Otherwise, the data will be excluded from deletion in whole or in part until an incident has been finally clarified.

Contract processing

The data you provide to us in order to make use of our goods and/or services will be processed by us for the purpose of contract processing and is necessary in this respect. It is not possible to conclude and process a contract without providing your data.

The legal basis for processing is Art. 6 (1) (b) GDPR.

The data collected will be deleted upon completion of the entire contract processing, in compliance with the retention periods under tax and commercial law.

Within the scope of contract processing, your data will be passed on to the transport company commissioned with the delivery of goods or to the financial service provider, insofar as the transfer is necessary for the delivery of goods or for payment purposes.

Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as ‘Google’.

Google Analytics helps us to analyse the use of the website and measure the effectiveness of our marketing campaigns. The legal basis for this is Art. 6 (1) lit. a GDPR. The user can revoke their consent to the use of Google Analytics at any time for the future in accordance with Art. 7 (3) GDPR via the ‘Cookie settings’ on our website.

Information such as the time, place and frequency of website visits and interactions with the website (e.g. click paths, ads viewed/clicked, clicks on links), including the user's IP address, is transmitted to a Google server in the USA and stored there for a maximum of 2 months.

Google also collects ‘demographic characteristics’ and can generate statistics that provide information about the age, gender and interests of website visitors. This is done through the automated analysis of advertising and information from third-party providers.

If the user has enabled personalised ads in their Google account and agrees to Google Analytics, Google can analyse usage behaviour across devices – i.e. across all devices that the user has linked to their Google account. Google creates models for cross-device conversions; we only receive anonymous statistics for this purpose, not personal data.

We use Google Analytics with an anonymisation function. This means that the user's IP address is truncated by Google within the EU member states or in other contracting states of the EEA Agreement.

Google uses the collected data to evaluate the user's website visit and compile reports on website activity for us. The data is also used to provide other services related to website and internet usage. Google may pass this information on to third parties if required by law or if third parties process this data on behalf of Google.
