II. RIGHTS OF USERS AND DATA SUBJECTS

With regard to the data processing described in more detail below, users and data subjects have the right

  • to obtain confirmation as to whether data concerning them is being processed, to access the data being processed, to receive further information about the data processing, and to obtain copies of the data (see also Article 15 of the GDPR);

  • to have inaccurate or incomplete data rectified or completed (see also Article 16 of the GDPR);

  • to the immediate erasure of data relating to them (see also Article 17 of the GDPR), or, alternatively, where further processing is necessary in accordance with Article 17(3) of the GDPR, to the restriction of processing in accordance with Article 18 of the GDPR;

  • to receive the data concerning them and provided by them, and to have this data transmitted to other providers/data controllers (see also Article 20 of the GDPR);

  • to lodge a complaint with the supervisory authority if they consider that the data relating to them is being processed by the provider in breach of data protection provisions (see also Article 77 of the GDPR).

Furthermore, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17(1) and 18 of the GDPR. However, this obligation does not apply where such notification is impossible or would involve a disproportionate effort. Notwithstanding this, the user has the right to be informed of these recipients.

Furthermore, under Article 21 of the GDPR, users and data subjects have the right to object to the future processing of data relating to them, provided that the data is processed by the provider in accordance with Article 6(1)(f) of the GDPR. In particular, an objection to data processing for the purposes of direct marketing is permissible.

III. INFORMATION ON DATA PROCESSING

Your data processed whilst using our website will be erased or blocked as soon as the purpose for which it was stored no longer applies, provided that there are no statutory retention obligations preventing the erasure of the data and provided that no contrary information is provided below regarding individual processing operations.

Customer account / Registration function

If you create a customer account with us via our website, the data you enter during registration (e.g. your name, your address or your email address) will be collected and stored exclusively for pre-contractual services, for the fulfilment of the contract or for the purposes of customer care (e.g. to provide you with an overview of your previous orders or to offer you the so-called ‘wish list’ function). At the same time, we store your IP address and the date and time of your registration. This data will not be passed on to third parties.

As part of the subsequent registration process, your consent to this processing is sought and reference is made to this privacy policy. The data we collect in this process is used exclusively for the purpose of providing the customer account.

Where you consent to this processing, Article 6(1)(a) of the GDPR forms the legal basis for the processing.

If the opening of the customer account also serves the purpose of pre-contractual measures or the performance of a contract, the legal basis for this processing is also Article 6(1)(b) of the GDPR.

You may withdraw the consent you have given us to open and maintain the customer account at any time with future effect, in accordance with Article 7(3) of the GDPR. To do so, you simply need to notify us of your withdrawal by email (datenschutz@lemonize.de).

The data collected for this purpose will be deleted as soon as processing is no longer necessary. However, we must take into account the retention periods required under tax and commercial law.

Credit checks and scoring

Where, as part of our range of goods or services, we offer you the option of paying by invoice and you make use of this, we reserve the right to obtain a credit report from a credit reference agency (such as Creditreform, Schufa, Bürgel or infoscore) based on mathematical and statistical methods. To this end, your data, insofar as it is relevant to the contract – such as your name and address – will be forwarded to the credit reference agency. We use the resulting information regarding the statistical probability of non-payment to determine whether we will offer you the option of paying by invoice.

The legal basis for this processing is our legitimate interest in ensuring the security of the debt in accordance with Article 6(1)(f) of the GDPR.

Server data

For technical reasons, in particular to ensure a secure and stable website, data is transmitted by your internet browser to us or to our provider and stored. These so-called server logs contain, amongst other things, the type and version of your web browser, the operating system, the website from which you navigated to our website (referrer URL), the page(s) on our website that you visit, the date and time of each visit, and the IP address of the internet connection from which our website is accessed.

The data collected in this way is stored temporarily, but not in conjunction with any other data relating to you.

This storage is carried out on the legal basis of Article 6(1)(f) of the GDPR. Our legitimate interest lies in improving the stability, functionality and security of our website.

The data will be deleted after 31 days at the latest, provided that no further retention is required for evidential purposes. Otherwise, the data is wholly or partially exempt from deletion until an incident has been fully resolved.

Contract fulfilment

The data you provide in order to make use of our range of goods and/or services is processed by us for the purpose of contract performance and is necessary for this purpose. It is not possible to conclude or perform a contract without you providing your data.

The data collected will be deleted upon completion of the contract and in accordance with the retention periods under tax and commercial law.

As part of the fulfilment of the contract, your data will be passed on to the transport company commissioned to deliver the goods or to the financial service provider, insofar as such disclosure is necessary for the delivery of goods or for payment purposes.

Google Analytics

We use Google Analytics on our website, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter referred to as ‘Google’.

Google Analytics helps us to analyse the use of the website and measure the effectiveness of our marketing campaigns. The legal basis for this is Article 6(1)(a) of the GDPR. The user may withdraw their consent to the use of Google Analytics at any time with future effect via the ‘Cookie Settings’ on our website, in accordance with Article 7(3) of the GDPR.

Information such as the time, location and frequency of website visits, as well as interactions with the website (e.g. click paths, adverts viewed or clicked on, clicks on links), including the user’s IP address, are transmitted to a Google server in the USA and stored there for a maximum of two months.

Google also collects ‘demographic characteristics’ and may compile statistics that provide insights into the age, gender and interests of website visitors. This is done through the automated analysis of advertising and information from third-party providers.

In doing so, Google creates models of cross-device conversions; we are only provided with anonymous statistics in this regard, not any personal data.

We use Google Analytics with an anonymisation feature. This means that the user’s IP address is truncated by Google within the EU Member States or in other signatory states to the EEA Agreement.

Google uses the data collected to analyse the user’s visit to the website and to compile reports on website activity for us. Google may pass this information on to third parties where required by law or where such third parties process the data on Google’s behalf.

Credit check and scoring

If we offer you the option of paying by invoice for our goods or services and you make use of this option, we reserve the right to obtain credit information from a credit agency (such as Creditreform, Schufa, Bürgel or infoscore) on the basis of mathematical and statistical methods. For this purpose, your data, insofar as it is relevant to the contract, such as your name and address, will be forwarded to the credit agency. We use the subsequent information about the statistical probability of a payment default to decide whether to offer you the option of payment by invoice.

The legal basis for this processing is our legitimate interest in the reliability of the claim in accordance with Art. 6 (1) lit. f) GDPR.

For technical reasons, in particular to ensure a secure and stable website, data is transmitted to us or our provider by your internet browser and stored.
